Right of Withdrawal
This document describes the right of withdrawal granted to consumers in connection with distance contracts concluded with GiaNet Media, pursuant to Articles 52-59 of the Italian Consumer Code (Legislative Decree No. 206 of 6 September 2005, as amended).
1. Scope of Application
The right of withdrawal described on this page applies exclusively to consumers, i.e. natural persons who purchase GiaNet Media services, subscriptions or credit packages for purposes unrelated to any business, trade, craft or professional activity they may carry out.
The right of withdrawal does not apply to customers purchasing as professionals, freelancers, businesses, sole proprietorships or legal entities (B2B contracts), for whom only the general contractual terms and any other agreements between the parties apply.
2. Withdrawal Period
The consumer has the right to withdraw from the contract, without giving any reason and without incurring costs other than those provided for under Articles 56(2) and 57(2) of the Consumer Code, within:
- 14 (fourteen) calendar days from the date the contract is concluded, for service contracts (e.g. subscriptions, credit packages, multimedia production services);
- 14 (fourteen) calendar days from the date of delivery, where the contract also provides for the supply of physical goods.
The withdrawal period is deemed to have been observed if the communication concerning the exercise of the right of withdrawal is sent by the consumer before the withdrawal period has expired.
3. How to Exercise the Right of Withdrawal
To exercise the right of withdrawal, the consumer must inform GiaNet Media – Giannetta Francesco of the decision to withdraw from the contract by means of an explicit statement, sent to:

The consumer may use the model withdrawal form provided in Section 6 of this page, or may make any other explicit statement of the decision to withdraw. Use of the form is not mandatory.
It is recommended to keep a copy of the communication sent and, where possible, to indicate the relevant order or contract details (order number, purchase date, service purchased) to facilitate identification of the case.
4. Effects of Withdrawal and Refund Arrangements
Where withdrawal is validly exercised within the applicable period, GiaNet Media will reimburse all payments received from the consumer, including any delivery costs (excluding any additional costs resulting from the consumer's choice of a delivery method other than the standard delivery offered), without undue delay and in any event within 14 (fourteen) days from the day on which GiaNet Media is informed of the consumer's decision to withdraw from the contract.
The refund will be made using the same means of payment used by the consumer for the initial transaction (via the Stripe payment circuit), unless the consumer has expressly agreed otherwise. The consumer will not incur any additional costs as a result of the refund.
5. Exceptions to the Right of Withdrawal
Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded in the following cases:
- a) Digital content or services already used or started. The right of withdrawal does not apply to the supply of digital content not supplied on a tangible medium, where performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal. At the time of purchase, and before the service begins, GiaNet Media requests the consumer's express consent to this effect.
- b) Personalized or made-to-measure services. The right of withdrawal does not apply to contracts for the supply of goods or services that are clearly personalized or made to the customer's specifications (for example: bespoke multimedia productions, editing, dedicated video/photo shoots, custom websites or graphic materials produced to order). Once work has begun in accordance with the customer's specifications, withdrawal is no longer possible.
- c) Services fully performed. The right of withdrawal does not apply to service contracts after the service has been fully performed, if performance began with the consumer's prior express consent and acknowledgment that they would lose their right of withdrawal once the contract had been fully performed by the trader.
In the cases described under (a), (b) and (c) above, the consumer's acceptance of the relevant conditions is requested clearly and explicitly before the contract is concluded or the service begins.
